Default Senior Judges Demand Test Case

This morning it was reported on BBC Breakfast News that senior judges are describing the current situation for consumers, in light of some recent judgments, that reclaiming the charges had become a lottery. They went on to say that what was needed was a precedent setting test case.

Comment
As this was clearly an indirect swipe at the OFT for their inaction I wonder how long the OFT will try to ignore THEIR remarks.

Whilst all would agree the only problem with a test case is that all other cases will be put on hold until a final outcome is reached. This could be some distance away as you can bet the banks will appeal any adverse judgment all the way to the HOL

I don't think any of the banks are willing to become the test case. They know the law and they know what they have been doing is unlawful.

Will the OFT continue to bumble through this mess?

If the OFT do their job the banks won't have a choice as either the banks can reduce their charges & offer refunds or the OFT can seek a binding judgment on the charges in general

A test case would clear up any confusion, and when it gets there I hope the claimant goes back more than 6 years. It will have to be a veyr carefully worked out claim but I think it has every chance of winning.
