I understand that buisiness account t&cs were not assessed at the hearing therefore, i understand that the penaltie issue may still be challenged on this type of account.

A point to note. RBS are not in the clear yet.

RBS will never be in the clear until either Sir Fred resigns or they pay back all the money that they owe to the customer.
