The problem that i am facing at the moment is when i started my claim i only asked for the 28 days notice that i was owed. Now i am thinking is it worth putting a application in and asking for loss of earnings at the rate a court would decide on ? as the defedants claim that i am owed 17 days and not 28 as claimed. So would it be worth mywhile or shall i wait till the hearing and ask then ?

Recieved letter from defendant sol advising that either i pull out or they will go for costs. Bearing in mind is a small claim.

They even have 3 witnesses to the contract never existing even though they started working there 1 year after contract came into force.

Recieved letter from judge for default judgement.

It says :

Your letter was referred to the district judge for his consideration and the district judge comments :

The district judge will not act on a informal approach to the court e.g byletter but only on a formal application. If defendant seeks to rely at the hearing on 19th november 07 on documents not supplied to you prior to it you can object at the hearing and the court may prevent the defendant from using them.

Well and truly gutted.

2 days to court good luck Honestly, have to say you seem to always have a claims or case going on, so i do hope it comes out in your favour.

If only it was that easy. however i have last night got another bundle together just in case any surpises turn up at court.
