Default Consider 'Libel' in your postings...

One of the issues facing posting comments on public forums, is Libel.
If you consider that any person can be sued for Libel or Defamation of Character based on what may be posted in the public domain (ie Forums, newspapers, MEssage Boards etc) - the following information sheet kindly researched and provided by sparkie1723, explains what is, and is not Libelous. Very worthwhile reading, and something to consider when anger or frustration could get the better of you when describing your case here!

In an effort not to detract from a serious post, when i saw the title i thought it was an appeal to make libellous statements in your posts!!.

When i haven't got a hangover and am not jet lagged ill try to read it.

I researced this aspect with a view to Credit Referenece Agencies, when they place a default on a persons credit file, and it is an incorrect entry, and the CRA will not remove it when asked, because the supplier says it is correct.
If your credit file is viewed by another institution, then this becomes libel , because it has been pulishe by the CRA and passed on to third party.
I have also discovered that in 1908 the Privy Counsel ruled that CRA's are not immune fron a libel Action being taken against them.

I believe that ruling still exists, but I can't find out if anyone has take action against a CRA, I'm still looking, if anyone comes across this I would appreciate them letting me know.
If it is outside the statuary time limit on libel of 12 months, then it reverts to a possible defamation claim for negligent miss- statements, which has a time limit of three years.

When I contacted Experian about this, they told me they were aware of the ruling, but would not say anything more about it.

A bit more for discussion.

Just brought this on to the forum as one needs tobe a just a little careful on public threads, the private ones would be "pretty safe " I would imagine.

I have made some claims on my threadabot RBS but I can prove mine.
